>> reporter: b.a.r.t's general manager entered these doors at 9:30 tonight. a federal mediator is at the table and 30 minutes ago union leaders came down and said there is movement and a counter proposal on the table but still no deal. about an hour to go and no deal yet. but b.a.r.t put a best and final offer on the table yesterday. the offer included a 12% raise but increased pension and health benefit contributions. b.a.r.t says they are as far as they can go financially. but there is room for movement in that deal. at 10:30 the president of the union said that the union made a counter proposal and b.a.r.t is considering it.

union leaders are advising commuters to prepare for a strike. >> we feel like we have reached the limit. the outer limit of what we are prepared to offer. >> we did make movement. we are still up there working. we wish we had a deal but unfortunately we don't. >> so still no deal but union leaders have a counter proposal on the table and negotiations continue. both sides they say are upstairs talking and close to a deal but they won't say what is keeping them from making that agreement. as the midnight deadline approaches, pressure is mounting to keep the trains running for thousands of commuters who rely on the system. but union leaders are telling us to prepare for a strike. they are preparing for a strike and commuters should also prepare for a strike. we will continue to monitor the negotiations and bring you

resources. that has all the information you need. if there is a strike we will be on early starting at 4:00 a.m. if you are counting on using ac transit, they issued a stroke notice today compounding the traffic troubles. george, this is huge. this would be a huge mess. ac transit is supposed to pick up the b.a.r.t slack. >> it definitely could. we are talking about 100,000 people who use ac transit every day. you couple this with the b.a.r.t strike and this could be a crippling blow. come thursday morning, you may not see ac transit buses on the road. >> will have to pedal harder. >> reporter: the union which represents more than 1800 bus drivers, mechanics and other workers has given ac transit a

72 hour notice they will walk off the job at 12:01 thursday morning if an agreement is not reached. this saturday the union rejected a proposed contract. >> it sends a clear message to the negotiating team and to ac transit that our members are still suffering from some of the debilitating cuts that they experienced during 2010, '11 and '12. >> a strike would mess up this rider's daily routine. he rides every day. >> people are going to strike, they're going to strike. i can't do much about it. just have to cope with it and hope things get better. >> reporter: while the union is looking for better pay it's the proemds to increase their health care contributions to $300 a month that has angered many union members. >> in this contract i would like to see an agreement that our

members are comfortable ratifying and that would bring our members to a place where they feel they are being respected and their work is being valued. >> reporter: and with the possibility of b.a.r.t striking at the same time, kevin will be either walking or riding bicycles to get to work. his message to all those negotiating -- >> don't be selfish. think about the public and get it together. don't be washington on us, microscale. >> reporter: ac transit would not go on camera just saying we did receive the notice and we are reviewing it to determine what steps to take next. that's the latest here. live in oakland. nbc bay area news. now to the south bay. a boy was rushed to the hospital after an accident on the vta tracks in north san jose. it happened at 7:30 this evening when a train was pulling into the station on north first

street. it's not clear how badly the boy was hurt. the boy was between the ages of four and seven. the sheriff's department has secured the video from the platform to determine what happened. tonight a triple shooting in san francisco. three people were taken to sf general. the shooting happened at 7:30 on rose street near buchanan. one person has life threatening injuries and the others are expected to survive. sfpd are investigating. workers will begin their day with a safety meeting after this construction worker died today. a load of rebar crushed him as he delivered materials to the new stadium. it's the second stadium death so far. four months ago a counter weight killed a mechanic at the site. crews are work around the clock to meet the opening deadline.

the pace of the project could have played a role in the accident. but the project co director disagrees. >> with the acceleration of the schedule is putting pressure on the schedule, labors and personnel on the site are more subject to accidents. >> is there a deadline pressure that could have played into that? >> no, ma'am. >> reporter: cal osha is investigating. fairfield police are searching for an arsonist tonight. police believe that the man in these photos started a fire in a wal-mart this morning. it caused several carbon dioxide containers to explode. no one was hurt. happening now, an explosion at l.a.x. this time outside the terminal where dozens of authorities are in the midst of an investigation. you see one of the helicopters over the scene. the explosion at the airport was

another dry ice bomb. police quickly found two other similar devices. last night a dry ice bomb went off in a men's bathroom in l.a.x. police do not believe that these were acts of terrorism. developing news in the philippines. an earthquake has collapsed buildings and roads. the quake struck 20 miles south of a town. 20 people have been killed and many more injured. authorities fear that more destruction is on the horizon due to aftershocks that could cause landslides. one parent calls it every family's secret that is killing our kids. tonight we investigate prescription drug abuse that has veteran d.e.a. agents concerned and what california is doing to

deal yet. we'll continue to keep an eye on the podium for you. it's called doctor shopping, bouncing from one office to another wracking up prescription drugs. >> it's a nationwide problem with deadly consequences. deaths are on the rise. but in california there is a new approach to curb the problem. >> i know you have been investigating a lot of this. >> and you won't believe this. a little factoid. according to the centers for disease control more people now die from misuse of prescription painkillers than die from heroin and cocaine combined. drug agents tell us the problem is so bad there are parties where young people dump prescription drugs into a bowl and grab a handful not knowing what they're getting.

law enforcemen lawmakers in california are ying to address this rising tide of prescription abuse using state law. >> he was loyal, charismatic, passionate. >> rick reads eulogies written by a.j.'s friends which were read at the 19-year-old's funeral less than a year ago. >> he kept his beat. >> reporter: a beat that last december stopped. >> i want people to understand that if their child died this way it doesn't make them bad people or their kids bad, they just made a mistake. >> reporter: a talented musician and 4.0 student, a.j. had just started his freshman year at uc santa barbara. no one could have predicted that just a few months later one night and one pill would take all that away.

>> not a day that goes by i don't kick myself for not understanding the problem. >> reporter: it was opana, a prescription opioid pain medication he took at a party, a drug not prescribed to him, a drug that combined with alcohol was deadly. while the loss and pain remains raw for a.j.'s parents, they are not alone. deaths resulting from overdosing or misusing prescription drugs are rising. deaths have quadrupled in west virginia, iowa, kentucky, and indiana. in california deaths are up 40%. and california is handing out the most prescriptions in the country, with nearly 400 million

scripts filled in 2011. bruce goldberg is assistant special agent in charge of the san francisco dea field office. he says that teens have easier access than ever before. >> kids are ingesting things they are not aware how dangerous they are. >> these are drugs meant to alleviate pain. >> reporter: it prompted a state senator to begin fighting four years ago to get a special system to track prescription drugs and the doctors who write them into law. lawmakers finally voted to fund the system and the governor signed it into law last month. the idea, to stop doctor shopping by letting doctors see a prescription record. it may have helped avoid two bay area tragedies. >> their personal stories made a difference to me. >> reporter: the stories of bob

and april. >> i'm so sorry i department know. >> reporter: her son, 21-year-old joey was at arizona state university four years ago when he took a trip to l.a. with friends and doctor shopped. he then later overdosed on a combination of prescription drugs. >> it's terrible losing a child. i don't know anything else that could be worse than this. >> just because it's a prescribed pill doesn't mean it's okay. >> reporter: bob's children were killed when a driver high on muscle relaxers ran them over. >> it has been a motivator to try to do something about it and hopefully prevent a tragedy that would be similar for someone else. >> reporter: it resulted in this new law which funds the c.u.r.e.s. system. >> i think we will make a dent in the abuse of prescription

>> they really are. >> if you have a tip for us, you can call us or e-mail us. an alarming number of babies are born addicted to prescription drugs as well. doctors in tennessee are seeing a lot of babies born hooked on drugs that their mom took in pregnancy like painkillers. the pane of withdrawal is so intense that the babies cry nonstop, claw at their faces and can't stand to be touched. the doctors are seeing a core responding number of drug dependent babies in new england and florida as well. now reports are surfacing that u.s. intelligence is collecting personal e-mail lists as well. the nsa is collecting the

contact book connected to e-mail databases. the u.s. says that americans are not targeted. but contacts of americans have been swept in. this is the latest leak from edwa edward snowden. tomorrow, employees of the lawrence livermore lab will begin to shut down operations. more than 6,000 people work there, making it the second largest employer in alameda county. most of the lab will be closed by the end of day on wednesday. as for the debt ceiling standoff, senate leaders met today. they are, works out details to

concern with us staying for the next 36 hours. off to the north, a light off shore wind means fog-free conditions for the next 24 hours. tomorrow morning we will feature some of the coldest weather. that's the cooler, denser air that is trapped into the valleys. 45 in santa rosa. and 46 in napa. in the east way, 49 in livermore. and slightly more milder for the south bay. 52 in san jose. an impressive warm up by tuesday afternoon. 20 to 30 degrees warmer from the morning lows. 82 in san jose. 83 in gilroy. for the east bay another day with mid-80s. walnut krooep creek. 82 in pleasanton. and also 79 in the castro valley. in the bay it's not going to be super warm but definitely above

average. san francisco winning out with the best forecast. 75 for you. 83 in san matteo. 77 in oakland. 82 in sonoma. let's look at the seven-day forecast. it gets better throughout tuesday, wednesday, and thursday. temperatures in the low to mid-80s inland. upper 70s to near 80 by the way. at the coastline upper 60s and low 70s at the coastline. fog-free conditions for the next 36 hours. saturday and sunday, the cloud cover increases and the temperatures go back down for next monday. no rain in the next seven days but there is hope in the 14-day forecast. i'll keep an eye on that. >> did he mention a 14-day forecast? >> he is keeping an eye on that. coming up a bedtime strategy that could improve your little one's behavior. back in a moment.

want to check in with the developing news. the b.a.r.t negotiations happening. 28 minutes and counting. this is the live picture of the podium where we expect some time in the next couple hours, negotiators to give us an update. negotiators are saying be prepared for a strike tomorrow morning. so make alternate plans if you are commuting. but there could be a deal reach reached at some point tonight. we will monitor the negotiations throughout the night.
